“With the mounting evidence of these civil rights abuses, we urge the Department of Justice’s Civil Rights Division to investigate the NYPD’s surveillance activities. The NYPD has extended its surveillance well outside of New York state, prompting members of Congress from New Jersey and elsewhere to ask for a federal investigation. This is now a national civil rights crisis, and the Justice Department must act accordingly.”

Rather than preventing the "13 terrorist plots" deterred by the NYPD, a part of the spying program led by police informants may have even led to their creation. These informants first identify young, poor, and in some cases mentally “unstable” Muslims, and encourage them to plot to attack New York City.:

According to Kelly, 13 plots to attack New York City have been deterred since September 11, 2001, none of which were prevented by Kelly’s program.

Colorlines.com reports that rather than preventing these plots, a part of the program led by police informants may have even led to their creation.

These informants first identify young, poor, and in some cases mentally “unstable” Muslims, and encourage them to plot to attack New York City. As reported by the New York Times, some of the cases that Kelly has identified as having been “deterred” would not have existed without encouragement from police informers.

In the most recent case, an NYPD “informer provided companionship and a staging area so Mr. Pimentel, a Muslim convert, could build three pipe bombs while the Intelligence Division of the New York Police Department built its case.”

In 2009, on a tip, the FBI and the New Brunswick police broke into an office and discovered five men busily operating sophisticated surveillance equipment. Four of the men were NYPD police officers, and the fifth was a CIA agent.

The conundrum faced by all of these public servants soon became apparent. Who should arrest whom?

Should the FBI agents and the local cops arrest the NYPD and the CIA agent for violating the U.S. and New Jersey constitutions, both of which prohibit searches and seizures without search warrants, and for violating federal and New Jersey laws against wiretapping and surveillance?

Or should the NYPD and the CIA agent arrest the FBI agents and the local cops for obstructing a “governmental function” (if it is a lawful government function) without a search warrant?
